RETURN & REFUND POLICY
Jacob Lamoureux — Official Website
Last updated: 2026-02-23
1. Overview
This Return and Refund Policy applies to all purchases made through the official Jacob Lamoureux website (the “Website”). By purchasing any product from this Website, you agree to the terms outlined below.
All products sold are original artworks and limited artistic objects created or authorized by Jacob Lamoureux (“Artist,” “we,” “us,” or “our”). Due to the unique, fragile, and often irreplaceable nature of these works, special conditions apply to shipping, returns, exchanges, and refunds.
2. Nature of the Products
All artworks sold:
-
Are original or limited-edition artistic pieces.
-
May contain delicate materials, experimental media, or non-standard surfaces.
-
Are inherently fragile and sensitive to handling, environmental conditions, and transportation.
-
May include intentional artistic imperfections, marks, textures, or irregularities that are part of the artwork itself and do not constitute defects.
By purchasing, the customer acknowledges understanding the artistic and fragile nature of the work.
3. Final Sale Policy
Unless explicitly stated otherwise, all sales are final.
We do not accept returns or refunds for:
-
Change of mind
-
Buyer’s remorse
-
Incorrect expectations about scale, texture, or artistic appearance
-
Minor variations from website images
-
Natural material characteristics
-
Damage occurring after successful delivery
4. Shipping Risk & Liability Transfer
All artworks are carefully packaged using professional protective methods appropriate for fragile art objects.
However, due to the unpredictable nature of postal and courier handling:
-
Risk of loss or damage transfers to the customer once the package has been handed to the shipping carrier.
-
The shipping carrier acts as an independent third party.
-
Jacob Lamoureux is not liable for damage, delays, mishandling, or loss caused by shipping providers.
Customers accept that shipping delicate artwork involves inherent risk.
5. Shipping Insurance
Where available, shipments may include carrier insurance at our discretion.
If shipping insurance is included:
-
Claims must be made directly with the carrier.
-
We may assist by providing documentation, but we are not responsible for claim approval or reimbursement decisions made by the carrier.
If insurance is declined or unavailable, the customer assumes full shipping risk.
6. Damaged Items Upon Arrival (Limited Exception)
A refund or replacement may be considered only if ALL of the following conditions are met:
-
The package shows clear external shipping damage at delivery.
-
The customer documents the damage immediately.
-
The customer contacts us within 48 hours of delivery.
-
The customer provides:
-
Clear photos of the exterior packaging
-
Photos of internal packaging
-
Photos of the damaged artwork
-
Proof of delivery date
-
-
The artwork remains in its original packaging and is not further handled or altered.
Failure to meet any of these requirements voids eligibility for review.
We reserve sole discretion to determine whether damage resulted from shipping or post-delivery handling.
7. No Guarantee Against Shipping Damage
Because artworks are sensitive objects, we cannot guarantee that items will arrive without minor physical changes caused by vibration, pressure, or environmental factors during transport.
Such occurrences are considered inherent risks of purchasing shipped artwork and do not qualify for refunds.
8. Incorrect Address & Delivery Issues
Customers are responsible for providing accurate shipping information.
We are not responsible for:
-
Incorrect or incomplete addresses
-
Failed delivery attempts
-
Packages left unattended
-
Theft after delivery confirmation
-
Customs delays or import procedures
Reshipping costs caused by address errors are the customer’s responsibility.
9. Refused or Unclaimed Packages
If a package is refused or returned due to failure to collect:
-
Original shipping fees are non-refundable.
-
Return shipping and handling costs will be deducted from any potential refund.
-
A restocking and handling fee of up to 30% may apply due to the fragile handling requirements.
10. International Orders
International buyers are responsible for:
-
Customs duties
-
Import taxes
-
Brokerage fees
-
Local regulations regarding artwork importation
We are not responsible for delays, seizures, or additional charges imposed by customs authorities.
11. Refund Method (If Approved)
If a refund is exceptionally approved:
-
Refunds are issued only to the original payment method.
-
Shipping costs are non-refundable.
-
Processing may take 5–15 business days depending on the payment provider.
12. Chargebacks & Payment Disputes
By purchasing from this Website, customers agree to contact us first to resolve any issue before initiating a chargeback.
Initiating fraudulent or unjustified chargebacks may result in:
-
Permanent refusal of future sales
-
Submission of documentation to payment processors
-
Legal recovery of associated administrative and dispute costs where permitted by law.
13. Limitation of Liability
To the maximum extent permitted by applicable law:
Jacob Lamoureux shall not be liable for any indirect, incidental, consequential, or special damages arising from:
-
Shipping or handling
-
Carrier delays or errors
-
Environmental exposure during transit
-
Loss of artistic value or perceived value
Total liability, if any, shall never exceed the original purchase price paid.
14. Policy Updates
We reserve the right to modify this policy at any time without prior notice. The version in effect at the time of purchase governs the transaction.
